This occurs when a party is liable for an injury due to failure to act in a reasonable way to avoid harm to others. In order to pursue a personal injury case based on negligence, the victim must have proved four elements of negligence.

1. The defendant must bear a duty to protect the victim from harm.
2. The defendant did not uphold his duty to protect the victim from harm.
3. The defendant’s actions, or lack of action, caused personal injury to the victim.
4. The victim sustained personal injuries, financial damages or other damages as a result of the defendant’s actions.
 

Strict Liability

This occurs when the defendant is not directly responsible for the defendant’s injuries, but is still considered responsible. If a dog bit the victim, the owner can be held responsible under strict liability.
